These Terms of Service ("Terms") govern your access to and use of Warstrife (the "Service"), operated by Crit Publishing Pty. Ltd. ("we", "us", "our"). By using the Service you agree to these Terms and to our Privacy Policy.
Plain-language summary: Warstrife is in open beta — the game is still being actively built and balanced. We're sharing it early so players can help us shape it. Because of that, match ratings, win/loss records, saved armies, currency, cosmetics, and any other progress may be reset when the game leaves beta. Nothing you earn during beta is guaranteed to carry over. Beyond that: be civil, don't cheat, don't run bots or scrapers, don't harass people, and don't try to break the game. We can suspend or remove accounts for any of the above. The Service is provided "as is" and we limit our liability to the maximum extent allowed by Australian law.
1. Beta status and progress reset
Warstrife is currently offered as a public beta. The Service is being actively developed, tested, and balanced, and you should expect features to change, appear, or be removed without notice.
- We may reset any or all beta progress — including match ratings (Elo), win/loss history, saved armies and regiments, in-game currency, unlocks, cosmetics, and any other account-bound data — when the beta ends, when a new season begins, or when a rebalance or schema change requires it.
- Beta progress has no cash value, is not a purchased good or service, and is not guaranteed to carry over to the launch version of the game.
- Any paid features introduced during the beta will be clearly labelled as such at the point of purchase, and the terms that apply to them (including any refund or carry-over commitments) will be disclosed before you pay. Until that happens, the Service does not sell anything.
- We will make a reasonable effort to announce material resets in-game and on the game's website before they happen, but we reserve the right to perform resets without prior notice where required to protect the integrity of the Service (for example, to remove the effect of a cheat or a critical balance exploit).
By continuing to use the Service during the beta, you acknowledge that beta progress is provisional and may be lost.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, your parent or legal guardian must read and accept these Terms on your behalf. We may refuse service at our discretion.
3. Accounts
- You may use the Service as a guest without an account.
- Accounts are created via third-party OAuth (Google, Discord). You are responsible for keeping your linked account secure.
- You may not create accounts using false information, impersonate others, or share accounts.
- You may delete your account at any time by emailing critpublishing@gmail.com.
4. Acceptable use
You agree NOT to:
- Harass, threaten, or abuse other players through chat, display name, or gameplay behaviour.
- Use or distribute cheats, hacks, bots, auto-clickers, packet manipulation, or any tool that gives an unfair competitive advantage.
- Reverse-engineer, decompile, or otherwise attempt to extract the game's source code or proprietary assets beyond the standard client that your browser receives.
- Attempt to disrupt or overload our servers (including DoS attacks or abuse of reconnection / matchmaking endpoints).
- Use the Service for any illegal purpose or to violate any third-party rights.
- Scrape, crawl, or harvest data from the Service without express written permission.
5. Enforcement
We may warn, kick, shadowban, temporarily suspend, or permanently ban accounts that violate these Terms. We may also remove offensive content (chat messages, display names) without notice. Enforcement actions are at our sole discretion and are not refundable (should the Service ever offer paid features).
6. Intellectual property
- All game assets, code, artwork, and text are © Crit Publishing Pty. Ltd. unless otherwise noted. All rights reserved.
- Tile art and third-party assets used under licence remain the property of their respective owners.
- Chat messages and usernames you submit remain yours, but you grant us a worldwide, royalty-free licence to display them within the Service and in reasonable moderation-related contexts.
7. Availability and changes
The Service is provided on a best-effort basis. We may modify, suspend, or discontinue features (or the entire Service) at any time without prior notice. We will make reasonable effort to announce material changes in-game or via the game's website.
8. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, except as required by law. To the extent permitted by the Australian Consumer Law, we make no guarantees that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by Australian law, Crit Publishing Pty. Ltd. and its directors, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Where liability cannot be excluded by law, it is limited to the re-supply of the Service or the cost of re-supplying the Service.
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited.
10. Indemnity
You agree to indemnify and hold harmless Crit Publishing Pty. Ltd. from any claims, damages, liabilities, or expenses arising out of your misuse of the Service, your breach of these Terms, or your violation of any third-party rights.
11. Governing law
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising out of or relating to these Terms or the Service.
12. Changes
We may update these Terms from time to time. The "Last updated" date above will be revised, and material changes will be announced in-game. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
